An act to amend Section 4275 of the Civil Code
Aún no rige. Esta ley se firmó el 30 de septiembre de 2026 y entra en vigor el 1 de enero de 2027. Hasta entonces el texto de las páginas de los artículos es el que gobierna, y la diferencia de abajo se muestra también allí, debajo de él.
El § 4275 del Civil Code permite a una asociación pedir al tribunal que reduzca el porcentaje de votos afirmativos que exige su declaración, cuando lo ha intentado y no lo ha alcanzado. Una de las condiciones que el tribunal debe constatar es que más del 50 por ciento de los votos se emitieron a favor.
Esta ley parte esa condición en dos y añade una alternativa: más del 37 por ciento, cuando el desarrollo es vivienda para personas mayores según el § 51.3(b)(4), tiene más de 6.000 intereses separados, más del 25 por ciento de ellos están ocupados por inquilinos, y su declaración no se ha reformado en al menos 35 años.
Las cuatro deben cumplirse. La combinación describe un problema concreto y no una relajación general: una comunidad muy grande y muy antigua donde tantos propietarios se han convertido en arrendadores que ya no se puede reunir una mayoría absoluta del poder de voto para nada.
