AB 739 — reserve study and agent fees become inspectable records
Two documents added to the list a member can demand, and an accounting requirement moved to where it belongs.
An act to amend Sections 5200 and 5500 of the Civil Code
Not yet in force. This act was signed on 27 September 2026 and takes effect on 1 January 2027. Until then the text on the section pages is the text that governs, and the difference below is shown under it there as well.
Civil Code § 5200 defines what counts as an association record, which is what § 5205 then obliges the association to produce. Adding to that list is the whole mechanism of the inspection right: a document outside it can be withheld without a reason.
This act adds the reserve study under § 5550 to the reserve-account entry, and adds a new item for statements of fees charged by the managing agent under § 5500(g). It also moves the requirement that those records be kept on an accrual or modified accrual basis out of the paragraph's closing line and into the definition of the general ledger itself, where it can only be read one way.
