Your annual meeting sets four deadlines

In California, moving an association to electronic voting is a rule change before it is a software change — and the earliest deadline falls roughly five months before the meeting it governs. Enter the meeting date to see where you stand today.

What each deadline is

148 days — election rules adopted

An association cannot vote electronically unless its election operating rules permit it. Adopting or amending those rules carries its own member-notice and comment process, which is what places this first deadline so far ahead of the meeting. Miss it, and the electronic election planned for spring stopped being available the previous autumn.

120 days — consent notice delivered

Members are notified that the election will be held electronically and told how to opt out. Consent to electronic delivery is governed by § 5260 and remains in force until revoked in writing, so this is a register the association maintains continuously rather than a campaign it runs once.

90 days — last day to switch method

A member may move between electronic and paper no later than 90 days before the election. After that the choice is fixed. This is why every California election is hybrid in practice, and why the paper and electronic channels have to reconcile into a single record.

30 days — device compatibility confirmed

The association confirms that each voting member's device can reach the voting system, so that a member is not disenfranchised by a technical failure discovered on the day.

Two dates that run after the vote

15 days — if the meeting fails to reach quorum, the reconvened meeting is held at least 15 days later, at a 20 percent threshold. See § 5115.

One year — a member may bring an action over a flawed secret-ballot election for a year after the result is announced, and the court must void the result unless the association proves the violation did not affect the outcome. Election materials are retained accordingly.
